Consideration And Legislation Protection Of Juvenile Family Education In China

Since the Right to education is a significant fundamental right that is affirmed and guaranteed by International law documents such as Universal Declaration of Human Rights, International Covenant on Economic, Social, and Cultural Rights, it is also a constitutional rights that is ruled by constitution in most countries. Juvenile Family Education is a new proposition in theories of constitution and Administrative Law, at the same time it is also a new object concerned by education and educational law theories, which is put forward on the basis of the right to education. The concept of Juvenile Family Education was inexistent before. Foreign scholars started the study of the Right to education protection in families earlier, however, their most Correlation Theories were scattered in discussions such as Education foundation theory construction. In our country, the concerns about the Education legal relationship issues are inadequate, furthermore, there are no specialized works about Juvenile Family Education, and the scholars who care about it in the field of constitution and Administrative Law are few, all because the study of educational law in China was started later. Based on this, the paper is started from Basic Theory of constitution, and combined with related theories of education and educational law, meanwhile, used for reference of Law on Compulsory Education to Protect Juveniles. We try hard to looking at the Consideration and Legislation Protection of Juvenile Family Education in China, searching the problem, consequently someday we could offer academic guide to Juvenile Family Education protection.
