In promoting the harmonious development of man and nature s today, our country agriculture transgenic technology has made considerable achievements. Recently, domestic and foreign research and application of transgenic technology is more and more extensive. Transgenic technology in to human life brings convenience at the same time, caused people to transgenic biotechnology environmental safety issues, especially transgenic effects on agriculture ecosystem problems. This situation leads to more and more people begin to pay close attention to problem of safety of environment of agricultural transgenic crops. Domestic and foreign scholars has dramatically increased the number of various ecological risk problem, it is often seen. Therefore, the agricultural transgenic crop environment safety problem, already became the various countries the development of transgenic technology and transgenic products industry production, current wait for a respect to facing the most serious challenge.This paper introduces the analysis of transgenic crops in China environmental safety legislation present situation, is clear about our country about GM crops for environmental safety legislation, the basic principles and the basic system of transgenic crops in China, find out the deficiency in the legislation of environmental safety. Secondly, targeted contrast analysed genetically related legislation environmental safety features, and points it is worth reference for the legislation of our country, such as, our country should draw lessons from the United States of America efficient and coordinated regulatory mechanisms and good public participation system, should also learn from the EU mandatory labeling of GM management system and strict supervision mechanism. Such as, the citizen’s environmental right as a constitutional right, the formulation of a higher level in transgenic environmental safety, environmental impact assessment system in China is introduced the principle of public participation, and puts forward how to perfect our country s transgenic product identification management system are proposed.
