With the rapid development of electronic commerce, network third-party payment service also grow up rapidly, In order to solve the problems brought about by the practical application of third-party payment, the People’s Bank of China promulgated and implemented Non-financial Institutions to Pay A Service Management Approach "on September1,2010, which marks the introduction of a long time in regulatory vacuum third-party payment has become" according to the law "up. But it also should be noted that the third party to pay as a new mode of payment, there are many problems to be solved in actual use, such as:the legal relations between the various main financial regulation in place. Therefore, the legal issues involved in third-party payment depth thought to improve the relevant legislation and institution-building, in order to better protecting the parties, especially the interests of consumers.The paper firstly introduces the background and concept of third-party payment, then describes several different modes of payment, its about an understanding through several ways in comparison to a clearer understanding of the third party payment. China’s legislation on electronic commerce is extremely scarce, and for e-commerce participants, the prime consideration to select third-party payment is the security issue, so we then discusses the legal status of third-party payment, as well as between the parties legal obligations relations as well as third-party payment of legal issues involved in the process. With the rapid development of online shopping and the resulting problems, in order to standardize third-party payment market, to protect the interests of the parties concerned, the paper concludes with the need to improve the relevant legislation and to strengthen supervision, and put forward some my own views.
