Financial industry is considered as the core factor of the modern economy, and the healthy development of it will facilitate the sustainable development of the national economy and society. It is widely admitted that opening to outside and developing international trade has been playing an important part in enhancing the exchange and communication of the advanced knowledge, scientific technology and human resources, which is suggested by the theories of new economic growth. In today’s tendency of global economic integration, the financial market is opening abroad day by day, especially with China’s accession to the WTO, the financial industry has been gradually opening to the outside. However, our domestic financial industry is facing both development opportunities brought by economic globalization and fierce competition with foreign banks which owned independent intellectual property rights and brand. According to the development of the western developed countries’ experiences, using the intellectual property to protect financial innovation is considered to be the inevitable choice for all countries to enhance their international competitiveness and promote the development of the financial industry. Therefore, our financial institutions need to analyze the current situation clearly, carry out the activities of financial innovation actively, speed up the construction of financial intellectual property right and implement the financial intellectual property right strategy unswervingly to strengthen the international competitiveness of our financial enterprises. Nowadays, both the theory horizon and the practice horizon of intellectual property are paying attention to find the best way to protect financial intellectual property rights and trying to improve the intellectual property law system.Considering our country’s policy of supporting and encouraging financial innovation, This paper has deeply analyzed the concept of financial products and its intellectual property attribute. Based on the basic theory of economics and law, this paper has combined the advanced financial intellectual property protection experience with our present situation, and therefore explores the effective way which Chinese financial institution can reference to protect their financial product intellectual property rights. Based on comparative and historical research, this paper is paying attention to the combination of the theoretical analysis and the case analysis. According to the basic principle of economics and law, the author is making efforts to put forward corresponding solutions to realize sustainable development of financial industry against the special historical background by researching on the necessity and feasibility of financial intellectual property protection.The first part of the paper defines the concept and content of intellectual product and financial product, and then make an intellectual attribute analysis of financial product to confront critics in the theory and practice field. Simultaneously, it concludes that it is necessary and feasible to improve the protection of financial intellectual property right.The second part of the paper mainly introduces the protection system of financial intellectual property right. Firstly, it elaborates the connotation and denotation of financial intellectual property and financial intellectual property strategy. Secondly, it analyzes the current situation of financial innovation and the great strategic significance of financial intellectual property protection. Lastly, it represents a comprehensive analysis of all-dimensional and wide-ranging protection pattern.The third part of the paper reveals the current situation of china’s financial intellectual property protection in a comparative way. On the one hand, it affirms the outstanding achievements we have already obtained, on the other hand, it points out the problems that existing during practice and development. In consideration of the present situation of our country, this paper refers to international practice to draw experiences and lessons from developed countries, and then puts forward a feasible countermeasures.
