Countries all over the world are experiencing unprecedented changes with the booming development of globalization, the new round of immigration wave is becoming even more violent caused by the imbalanced allocation of labor force and natural resources on the international scene, by the increasingly contacts among countries and the unprecedented integration trend in the aspects of economy, politics and culture etc.The problem of transnational population movements has become a nonnegligible topic for discussion in the course of globalization. It has direct or indirect bearing on countries in the worldwide when refers to the politics; economy; culture and the security and stability of one country. The orderly development of transnational population movements will boost the exchange of economy and culture and integration among the countries all over the world, but also things like illegal immigrant have brought many problems on the economy development and national security.Owing to the long time deficiency on the unified, effective immigration law system on the international level, countries all over the world failed to establish the perfect cooperation and coordination mechanism on the immigration area, and results in the huge legal risk and legal loophole on the labor force transnational movements in the current situation, and then have a bearing on the commodity, capital, the development of multinational business service and the country’s stability. On the aspects of human rights, we still face the legal system absences on international migrants.The problem of transnational migrants is becoming the focus of concern on the international law area, and then it has an important significance of establishing sound legal system on the international immigration area. Not only it could promote the effective allocation of global human resources, but also could safeguard the nationalsecurity, guarantee the legal rights and interests of citizens, promote world peace and stability. China is a country with large population and a long history of migration; in the law of Tang dynasty it has regulations for the immigrants. With the deepening degree of reform and open, China’s population of immigrants and emigrants is gradually increasing. The overseas Chinese not only have national blood relations with China, but also have right and obligation relations involves nationality, migration management and inhabitation and so on which are confirmed by law. The perfection of laws and regulations on the China immigration field has an important significance for the perfection of socialist legal system.This article is divided into four chapters to tease apart the international immigration law system basically.The first chapter introduced the general situation on the problem of international immigration which involved the concept, classification and current situation of international immigration. Especially focuses on causes and motives of the international immigration wave.The second chapter introduces the legal system and right protection of international immigrants, analyses the legal characteristic and source of law and legal basis on international migrants. The author elaborates the legal basis on the source of right, content of right, right relief of international migrants.The third chapter mainly introduces the current situation of the judicial practice of the European Union immigration legal system which are modeled by Germany, hope that will bring reference for our country through research on the Germany migration area. The fourth chapter is about the construction and development of China’s international immigration law, it analyses problems and drawbacks of China’s immigration legal system, and then provides referable measures to establish and perfect China’s immigration legal system from six aspects. The conclusive part summarizes the basic legal requirements of the international immigration law system, and the work we are going to do when it refers to the establishment and perfection of China’s immigration law system.
