Analysis On The Objective Integration Of Litigation In The Case Of Copyright Litigation In Our Country From The Litigation Case Of Rolling Stone Music

This thesis topic from my self chosen, I met a case when I did my practice in a law firm, in the inspiration and guidance of lawyer HuangHuiMing and professor TangChaoHua,I chose the case to be my research object, then I collected and analyzed the case, deeply dig legal theories, and finally finished it.The roughly content of the case as follows:Rolling stone international Colt, prosecuted,Music nets, when the complaint was submitted to Shanghai intermediate people’s court, the latter requested the former to split prosecution into many cases. If so, this case will be broken down into more than600case prosecution, and the lawsuit cost will be up to600million Yuan. Lawyer HuangHuiMing felt helpless about this, because if they break up prosecution prosecution, Rolling stone international Co.LTD.would be not worth the candle.In nationally, though not all of the court is ask party split prosecution, but Legal research does not only research on common phenomenons,but also research on incidental case. So I chose this case as my research object.To this case, my opinion is that the court should merger the prosecutions, for this can achieve litigation economy, debase lawsuit cost and avoid making contradictory judgments. But without clearly ruled by the law, this would be empty words.Therefore, to such cases, I think that the law may ruled clearly what cases should be merge red and spited. This is also essential for legal society.
