Cross-border environmental pollution and damage events in the international community are toomany.In the use of nuclear energy process if nuclear accident happen, environmental factors such asatmosphere, soil, oceans will have cross-border environmental impact and persistence severitydamage,causing adverse environmental damage on other countries as well as the environment outsidethe limits of national jurisdiction. Transboundary environmental impact assessment system as one ofthe mechanisms to prevent transboundary environmental issues, has a solid theoretical heritage andprospects for development, but given that it is still in the fledgling stage of development, we need amacroscopic and detailed analysis to in favor of the system to extend to a wider area. In the peacefuluse of nuclear energy, both the practical needs and the legal basis of the system, need it introduced.Therefore, a comprehensive analysis of the transboundary environmental impact assessment system,constructed a perfect cross-border environmental impact assessment procedures in the field of nuclearsafety system, can achieve the unity of the theoretical value and practical value. By thecommunication of information and preventive measures prior discussions, it helps to prevent nuclearleakage of transboundary harm, strengthen cooperation between countries,ensure the safe use ofnuclear energy and avoid the generation of international disputes. Through historical research, toexplore the emergence and development of transboundary environmental impact assessment.Through the use of text analysis, analysis the existing cross-border environmental impact assessmentlaws and regulations content deficiencies and problems,paving the way for the next perfect spare. Themain use of the method of combining theory and practice of transboundary environmental impactassessment system can buil a path to transboundary environmental impact assessment of nuclearsafety, construct perfect system.Besides the introduction, is divided into four parts, there are more than50,000words in this text.The first part generally introduce the transboundary environmental impact assessment. This section firstproposed the concept of it, and then analyze the importance of the system and review the historical development ofit. We can recognize that the system just produced in recent decades, not yet formed a global FrameworkConvention, but in view of its role and value it will develop in the future. Then the part focuses on analysis of thetheoretical basis of the transboundary environmental impact assessment.There are inseparable, interdependentrelationship between these different principles of international law and transboundary environmental impactassessment system.Principles of international law promote the latter to produce and perfect, which is a concretemanifestation of the former and system security.The second part first analysis the transboundary environmental impact assessment in three different areas, and set specific examples to illustrate. Besides some useful cross-border environmentalimpact assessment practice between countries (in the Caspian region, for example), also need toconsider the adverse environmental impacts in international and shared areas and some international inpractice, the financial institutions already take transboundary environmental impact assessment as oneof the important conditions for the borrowing of funds. Secondly, the difficulties faced in theapplication of it has been done a meticulous combing. Start from specialized regulate the transboundaryenvironmental impact assessment "Espoo Convention", the system in the treaty norms,publicparticipation and so on are not comprehensive and clear. The meaning of the program is too large,and interoperability is not strong in practical applications. Therefore the system should to beimproved.Ihe third part, cross-border environmental impact assessment focus on applying in the field ofnuclear safety.This field can couse of transboundary harm, as well as the law calls for the system inthe nuclear safety. Analysis of the necessity and feasibility of application of the system, and theobstacles in the application help us to build a perfect system.Last part analyzes the path of transboundary environmental impact assessment applyzing inthe field of nuclear safety. Expansion of the Espoo Convention to acceding countries directly appliedto the field of nuclear safety or establish specifical nuclear safety transboundary environmentalimpact assessment system is discussed,and choose the last way. Following sections discuss theconstruction method in detail, the thought to be rich to obtain recognition system; perfect content; theInternational Atomic Energy Agency as well as international financial institutions also play animportant role. Finally, based on the actual situation of China’s legal advocates that China shouldpromote the establishment of transboundary environmental impact assessment in the field of nuclearsafety.
