The legal problems existing in highway construction supervision belong to theresearch scope of Economic Law and Traffic Industry Law. Based on the EconomicLaw Theory, the thesis conducts a study in light of the difficulties and legal problemsarising in highway construction supervision. The basic task of Economic Law is torealize the transition from Power Economy to Legislative Economy. Economic Law isthe response to market defect made by the nation through legislation. Throughlegislation, the Economic Law regulates the management of highway constructionsupervision so as to make highway construction legalized and standardized. Based onlegal theory, the thesis conducts a study of legal system in highway constructionsupervision. Thus, it contributes to the formation of basic theory of law in highwayconstruction supervision and legal system in practice operation. As a result, itstimulates the development of legal system in highway construction supervision aswell as the development of the entire transportation industry.In accordance with Economic Law, the thesis makes analysis of the legalsystem in highway construction supervision. According to our country’s currentsituation and taking correlation theory of economics, the thesis analyzes the attributeand property right of highway and illustrates the importance of supervision based onextensive collection of material and system analysis. By the method of contrastanalysis, the thesis analyzes the adjusting orientation that Economic Law andAdministrative Law leads supervision to. Applying interdisciplinary research method,the thesis makes a deep analysis on the legal problems existing in highwayconstruction supervision. In addition, taking advanced experience from abroad, thethesis puts forward the regulation system for our country’s highway. On the basis ofthe basic theory of economic law, the thesis demonstrates the legal system of highwayconstruction supervision based on which the countermeasure and suggestion areproposed to perfect legal system of highway construction supervision.Apart from introduction and conclusion, the thesis consists of five parts. Throughcombining correlation theory (concept) of supervision, the first part illustrates the necessity of supervision and conducts research on highway construction supervisionlaw using economic and law theory. The second part elaborates the nature andcharacter of legal concept of our nation’s highway construction supervision, andsummarizes the main content and status quo of legal system in highway constructionsupervision. By means of analyzing and using for reference the foreign highwayconstruction supervision modes, the third part analyzes and concludes the mode torealize highway construction supervision in our nation and its approach. The forthpart analyzes the role the law plays and the value the law reflects in highwayconstruction supervision. The fifth part puts forward the existing problems. Throughtaking economic and law theory, legislation and law enforcement as reference, thispart analyzes the causes to the problems and proposes suggestions for solving theproblems so as to propose legislation suggestions for formulating and implementinglaws and regulations related to highway construction supervision, and completingtheoretical basis.Through the theoretical and practical analysis of highway construction supervision,the thesis strives to analyze and solve the existing problems using the basics ofeconomic and law theory, proposes the legislative mechanism of the legal system ofhighway construction supervision and the basics of economic and law theory, andprovides theoretical basis for the perfection of relevant legal system and theestablishment of sound legal system. Therefore, the thesis possesses a certaintheoretical and practical significance to promote the development of legal system ofsupervision in our country.
