| High-tech play an irreplaceable role in the development of today’s society, and thecompetition of the country’s comprehensive national strength is increasingly reflected inthe high-tech competition. In the knowledge economy era, the development ofinformation technology accounted for most of the high-tech, and the patent system hasplayed an invaluable role in the development of high technology process. Therefore, theworld attach great importance to the development of high-tech and continue to improvethe system of legal protection to promote technological innovation. We have a lot ofproblems to cope with in high-tech patents legal protection, and the article is to copewith these problems.The paper is divided into four parts. The first parts is to introduce the high-techpatent legal protection. This chapter consists of two parts. The concept of high-tech andrelated content is described in, the first part. I think that the high-tech is the newtechnology group, which is at the cutting edge of technology, closely related withintellectual property system, high investment, high permeability, high-profit, high-risk,and high intelligence. The High-tech is unique. The second part describes patent lawprotection plays an important role in the development of information technology.The status quo of high-tech patents protection in our country and foreign countriesis introduced in the second chapter. The first part describes the conservation status ofChina’s high-tech patent protection; the second part describes the conservation status ofhigh-tech patent protection of the United States and Japan. Our country should learnfrom the two countries.The third chapter is to introduce the problems existed in the high-tech patentsprotection. Firstly, the case of apple peel520is discussed. The key problem inhigh-tech patent legal protection is the lag of the legal system. Secondly, specificanalysis of the inadequacies in high-tech patent protection is described in four aspects,which is procedures, conditions, protection period and patent infringement from thepatent.The fourth chapter analyzes the legal perfection of China’s high-tech patentprotection. First of all, improve the Patent Law on the high-tech patent protectionsystem, including expanding the scope of patent protection, simplifing the patent-pending process，increasing the flexibility provisions of the patent protectionperiod and improving several aspects of patent infringement protection provisions.Finally, I believe that making unified trade secret law, and Anti-Unfair Competition Lawinto the high-tech patent legal protection system is necessary. |
