The minimum wage institution is based on the national force of the means of basic survival needs of the protection of laborers themselves and family members of a future system. Many developed countries and most developing countries in the world have established a minimum wage institution in China in1993to establish a minimum wage system. Since the implementation of the minimum wage system, the minimum wage system to protect the legitimate rights and interests of vulnerable groups, maintenance of the social nature of fair play important and active role, has also exposed some problems in the practice run. At present, China is the rapid economic development stage, the regional imbalance in economic development, labor shortages make some places substantially raise the minimum wage standard, the blind and raise the minimum wage, also increased the labor time actually harm the workers’ interests. Writer visited100nationwide garment enterprises; try to show the status of implementation of the minimum wage system and the main problems. The minimum wage system has not been the full implementation in labor-intensive enterprises, especially the clothing this emerging industry, implementation of the minimum wage system in a certain degree of difficulty. The real wages of many workers is still far away from the minimum wage. It reflects the main issues include the implementation of the minimum wage system presents a laissez-faire, individual local adjustment of minimum wage standards to develop unplanned, special forms of labor wage calculation is not clear and the execution and supervision and lack of other issues. The combination of the characteristics of China’s economy to make recommendations for the improvement of the minimum wage system in China, China’s vast, uneven economic development, labor-intensive enterprises and foreign trade-oriented development of the industry imbalances. Author believes that China should implement local differences in the industry combining the minimum wage system, to protect the minimum wage system to play the role of practical significance. Clear legal provisions on the calculation method of the form of special wage. Minimum wage system requires not only further improved, but also to strengthen supervision and management, the minimum wage system in China is still part of the regulations, a low level, is not sufficient to reflect the role of the force of law is not conducive to that meted out to the illegal enterprises. Improve the legislative level of the minimum wage system, the establishment of the offense of criminal responsibility, and strengthen local regulatory propaganda, supervision of the initiative is recommended.
