Legal Research On Marine Oil Pollution Damage Caused By Offshore Oil Exploration

Development of human society can not be separated from Oil.As the population of the world continues to grow and the rapid development of industrial, land-based oil exploration gradually failed to meet the consumption and industrial development needs. Marine oil is rich in resources and utilization of offshore oil resources becomes an important way. With the development of new and modern technology, marine oil extraction technology is maturing, it provides a good solution to ease the energy shortage problem and the marine environment. There are many channels to produce marine oil pollution, including marine shipping and offshore oil exploration. Blowout, pipeline rupture accident caused by offshore oil exploration and development will bring serious environmental pollution. The international community is extremely concerned about the problem of marine oil pollution, and has made unremitting efforts to minimize pollution to improve the marine environment.This article is divided into four parts.The first part is an overview of the offshore oil exploration and oil pollution damage. It introduces the concept of offshore oil exploration and oil pollution damage, the causes, distribution and the impact of biological resources, ecosystems, economic, and human, and make briefly instructions of recent major domestic and international offshore oil exploration and oil pollution damage accidents and their impact.The second section describes the status of the Offshore Oil Exploration and Oil Pollution Damage of International Legal System. In accordance with the geographical division,it make a brief description of the global conventions and regional conventions legal regulations involved in Offshore Oil Exploration and Oil Pollution Damage and make typical legislative analysis of the United States, Canada.The third part,it bases on the status of offshore oil exploration and oil pollution damage of the offshore oil exploration activities in the oil, according to international legal documents, analysis of the contents of the relevant legal documents, implementation and development process, reveal the deficiencies of the existing international legal instruments and proposes recommendation of the marine oil pollution for further reduce and elimination, making the international legal regulation of offshore oil exploration more perfect.The last part it extends to China, makes the description of the status of China Offshore Oil Exploration and Oil Pollution Damage legal regulation, points out that China’s offshore oil exploration and oil pollution damage legal issues, and makes recommendations from the legislative level. In order to protect the international environment safety to make marine environment in the petroleum exploration and development activities get good protection.
