Single Women Reproductive Rights Problem Research

Fertility is the fundamental way for the continuity of human race. The fertility pattern in the past was achieved through the marriage of both sexes. However, with the modern evolution of marriage and the advances of reproductive technology, the traditional fertility pattern is facing increasingly obvious changes. For the development of society and diversity of lifestyle, more and more women choose a single way of life, but their desires to have babies never stop. The demands of the fertility of single women should be paid more attention. So how to ensure the reproductive rights of this group is not only a matter of law, but a significant social problem.The thesis discusses the different theories about fertility in china and abroad on the basis of meaning and scope of the reproductive rights of single women. Using the empirical and comparative and other research methods, it analyzes controversies for single women’s reproductive rights among the different scholars. Combining with the various views of scholars, the thesis then explores the features and restrictions of the female reproductive rights. After analyzing the social and legal barriers and restrictions for realization of reproductive rights for the single woman, the proper solutions are proposed. Finally, according to our legislative practice, the thesis analyzes the current situation and disadvantages of the protection for reproductive rights of single women by constitutional law and civil legislation and makes clear the scope and realization conditions of the rights of single women. Reproductive rights should be affiliated with the moral rights and identified as constitutionally fundamental rights. The specific measures for the protection and realization of the reproductive rights of single women will be proposed from the respects of civil marriage legislation, the specific implementation details and the improvement of technical reproduction mechanism.
