The Study On The Operation Of Supervision Right Of The Provincial People’s Congress Standing Committee After The Enactment Of The Supervision Act

The supervision right of the People’s Congress and its Standing Committee is an important anthority entrusted by the constitution.And it is also the most commonly exercise anthority of the People’s Congress and its Standing Committee. Due to the People’s Congress and its Standing Committee’s importantance in China’s political life, their supervision right become the most central and most authoritative supervision in the national power supervision system. Strengthening the supervision of the People’s Congress and its Standing Committee is the fundamental for ruling the country by law and building a socialist country ruled by law. Also, improving the operation of the People’s Congress and its Standing Committee supervision is the need of constructing socialist political civilization.August2006, with the enactment of the Supervision Act. the operation of the People’s Congress and its Standing Committee supervision caused the attentition of people again. However, owing to each district is not identical, and the Supervision Act is difficult to meet the specific needs of different regions’supervision work. So, it is forcing each province to formulate laws and regulations relevant to supervision. This paper takes the statistics and analysis about law-making situation of each province as an entry point, and researchs the operation of superation right of the Provincial People’s Congress Standing Committee from the whole process of supervision issues production and processing. It tries to find out the innovations in operation of superation right of the Provincial People’s Congress Standing Committee based on the actual cases.There are5parts in this paper. Chapter one is an introduction, which introduced the background of my choice item, research status, basic thoughs and research methods. In chapter two, the ideological origin of People’s Congress supervision has been clear up, as well as its legal basis and elements. Chapter three is a main part. It firstly calculated the law-making situation of each province, and analysed it. Then it uesd the process of generating, considerating and disposing supervision issues as clue to discuss the operation of superation right of the Provincial People’s Congress Standing Committee, based on specific cases. Next, analysed anddescripted the innovation of supervision work with cases. In the fourth chapter, some problems existed in the operation of supervision right have been found out, also the deep-seated reasons. The fifth chapter pertinently gave some suggestions on how to improve the operation of supervision right of the Provincial People’s Congress Standing Committee.This peper combins statistical analysis with empirical research, investigate the operation of superation right of the Provincial People’s Congress Standing Committee from a new point of view. Thus, it is not only catch sight of the achievements we have got, but also face up to the limitations. All of these have great practical significance to improve the socialist democratic politics and to speed up the construction of socialist country under the rule of law.
