The Problem Of Community Correction In Our Country And Countermeasure Research

Community correction is a prison correction corresponding to the non-custodial penalty enforcement system, which originated in the middle of nineteenth Century in Britain and America, is a kind of penalty execution system internationally practiced. The community correction in China began in pilot sites from2003, and was applied countrywide in2009. This article explained the necessity and feasibility of the community correction on the connotation and theoretical basis of community correction in China, and attempted to combine the foreign community correction experience and results of reference, with the actual situation of Baoji City, analyzed and summarized community correction of the achievements and shortcomings in China, discussed the practical problems encountered in conducting community correction work, and get the pertinence suggestions for solution and completed, so as to make a positive exploration for the establishment of the modern concept of execution of community correction system.This paper is divided into four parts as follows. The first part is the scientific connotation and theoretical basis on community correction. This part mainly introduced the concept and characteristic of community correction, and described necessity and feasibility in our community correction theoretically. The second part is the status quo and analysis of foreign community correction. Western community correction has been more mature, and the community correction system is perfect with each passing day. The third part is present situation and the existing problems of community corrections in China. based on China’s community correction legislation present situation and the present practical situation, combining the community correction work experience practice and inadequacy in Baoji city, there were some problems, such as the faultiness legislation, low people self-identity for the community correction, insufficient community correction stuffs and funds, the worse coordination of various departments, etc. The fourth part is proposal on completing the community correction work in China. In view of these questions, the present community correction work should pay attention to improve legislation, promote changes and development of relevant laws and system, strengthen propaganda to gain popular support, add non-custodial penalty and the non-custodial penalty enforcement measures application, establish and improve the community correction workers, vigorously promote community correction system.
