Research On The Problems And Countermeasures Of Community Correction

With the continuous exploration and practice of the international society in the socialization of execution, the system of criminal execution in China conform to the trend of the international society, the non imprisonment penalty is included in the execution system of the penalty. From 2003 onwards, the central judicial administrative agency decided to implement community correction work·in some areas of china. The preliminary implementation of the work of community correction in our country has achieved certain results, after which central judicial administrative agency decided to implement that system nationwide. In February 25,2011 the "Criminal Law Amendment (Eight)" was passed on Eleventh National People’s Congress Standing Committee. In this amendment, the community correction system was formally defined. The emergence and implementation of the community correction system complies with the trend of the socialization of execution is our country. It inherent the requirement of the change of criminal policy and embodies the humanism thought of punishment. Then the central judicial administrative agencies jointly issued the Community Corrections Act. This act defined daily supervision and administration of the correct object, the correction method, the correction work, which provides the basis for the daily supervision and management of community correction. Different areas have different in local economic development, geographical structure, culture and community service functions. Du to which different areas show different characteristics and face different problems during the implement of the community correction, Social formation of China’s city-country "dual structure" has and will exist for a long time. In the relatively developed cities, the community function is relatively mature. Financial and public service supporting mechanism provided by the government made it more convenient for cities’ community corrections agencies to use social resources. So, the community correction work in that region made more achievements and fewer problems. Compared with the cities, community corrections in rural area are particularly slow and facing more difficulties. Fuliang County is a typical agriculture county. This paper takes the community correction of Fuliang County as its investing object and gives a brief summary of community correction in China base on the research of community correction organization, participation in community correction, crime type of prisoners, income stream of prisoners, and the daily supervision and management of Judicial Administrative Stations. Through the study of the above facts, this paper pointed out the existing problems, analyzes the reasons and gives corresponding countermeasures to make our country’s rural community correction work running on a healthy and stable track.
