Property management in the modern sense since be introduced to China’s inland, itsdevelopment of regional has been confined to urban areas.In China’s rural areas, the villagerscommittee exercise the functions of the property management, the true meaning of ruralproperty management organization does not exist.At the beginning stage of ruraldevelopment,The villagers committee plays the role of rural property managementorganization,which has played a positive role in the management of rural property,and italways improved the majority of the villagers’ living standard.However, with theimplementation of the diversified development of rural affairs and the rural land policy, themode of villagers’ committees escrow rural property can not meet the needs of villagers,itneed specialized rural property management organizations involved in the management ofrural property.Because the villagers’ committee management of rural properties and propertymanagement theory is inconsistent, so the rural property management organizations cannotbe applied to the regulation of the "Villagers Committees Organization Law ".Has alwaysbeen ignored by the legislators of rural property management organizations legislation isincreasingly apparent.Start from the status of rural property management, this thesis furtherexplain the irrationality about the the villagers’ committee act the functions of the ruralproperty organization, and on the basis of the experience to learn from foreign rural propertymanagement model,then proposed the theory of reconstruct the pattern of rural propertymanagement organizations properties.and on the basis of discussed the rural propertymanagement organization,the management subjects,proposed the view of shouldbecomposed of owners groups to manage in accordance with the urban propertymanagement model.provides a model of construction the property management organizationfor the developed rural.Because the remote west rural do not have the condition of developproperty management,so the point of this article mainly aims the developed rural.The maincontent is divided into four chapters:The first chapter,describe the status of rural properties and rural propertymanagement.First,discusses the prevalence of the properties and property management in therural areas,analysis the conditions generated by the property management and the reasonswhy the rural property management has been ignored.Then describes the types and theirimportance of the rural property management.The second chapter,analysis legislative situation of rural property managementorganization.First,discusses the functions of the existing rural property managementorganizations exercise by the villagers’ committee, and analysis the reasons for this hostingmodel;Then discusses the villagers’ committee to act this function is unreasonable,and structure the rural property management organization is lack of legal basis, pointed out thatrural property management legislation is imminent.The third chapter,A brief analysis of the extraterritorial rural property managementorganizations and their legislative status, so that the reconstruction of rural propertymanagement organizations can learn from the positive experience.The fourth chapter,Analysis the content of the rural property management and theproperty law, point the view that property management organization in rural areas should beseparate legislation,and reconstructed rural property management organizations from thenature of the groups of owners、the family as the management subject and the number ofvotes determined in accordance with the Homestead area and other aspects.
