The Study Of The CSR Of The Private Enterprises In The View Of The Labor Rights Protection

Since the generation of the corporate social responsibility at the beginning of the20thcentury, it becomes and has become the hot issue for the experts and the practicepersonnel to study and discuss. After the intense discussion and the beneficial practiceand promotion of the western countries, the idea of the corporate social responsibilitywill become an irresistible trend. Especially after the corporate social responsibilitymovement taking place in America during the1990s, the idea has gradually beenrecognized by the most developing countries. And as the biggest developing country,China will stand in the breach. The practicing of the SA8000standard and laborstandards, production code etc, labor rights protection has been in the core of thecorporate social responsibility.In this paper, the corporate social responsibility will be discussed. Andstakeholder theory, social contract theory, corporate ethnics theory and labor rightstheory will be the supporting points of the paper. According to the theories, thecorporate not just purses the benefit maximization, and the stockholder is not the onlystakeholder. Except the stockholder, the corporate should pay more attention on thepublic interests like employees, consumers, environment etc. And among them, theemployee, in other words, the labor rights protection, is the core of the corporatesocial responsibility, and the employee is the biggest stakeholder. And according tothe social contract theory, the corporate is the tacit understanding contract of theindividual, organization and institution, and a series of agreements based on these.The corporate should ensure that the interests of the stakeholder should be protected.On that basis, the study of the social responsibility of the private enterprises in ourcountry will be conducted in the view of the labor rights protection.After ensuring the supporting points, this paper will define the content of thelabor rights protection; introduce the development situation of the private enterprises,and the particularity of the development of its corporate social responsibility. Basedon these, the current situation and the problems of the responsibility of undertaking the labor rights protection of the private enterprises will be expounded, andfurthermore, this paper will analyze these problems and propose some targetedmeasures.In addition to the introduction and conclusion，this paper will contain threesections.The first section, overview of the study of the CSR of the private enterprises inthe view of the labor rights protection. It introduces the domestic and overseasresearch summary of the corporate social responsibility, research situation of thesocial responsibility of the private enterprises in our country, four theories ofcorporate social responsibility, stakeholder theory, social contract theory, corporateethnics theory and labor rights theory and defines the concept of the corporate socialresponsibility. And furthermore, it will define the concept and the extent of the laborrights protection, and sort out the relation between the labor rights protection andcorporate social responsibility. And these will provide the theoretical foundation forthe research of the social responsibility of the private enterprises in the view of thelabor rights protection.The second section, from the introduction of the state development of the privateenterprises and the development history of the corporate social responsibility of theprivate enterprises in China, the particularity of the development of the corporatesocial responsibility of the private enterprises will be highlighted, and then will focuson the current situation and the problems in the view of the labor rights protection.The third section, the reasons will be analyzed, and the targeted measures will beproposed,and in this way, the private enterprises will prefect the labor rightsprotection system and they will perform their corporate social responsibility better.
