As an essential element of human right, labor right is the fundamental guarantee ofhuman survival and development. Equal right to employment is the basis and premise of thelabor rights. In the current labor market, the status of men and women are unequal, womensuffer serious gender discrimination, and a variety of labor rights are constantly subjected tovarious violations.By the questionnaire survey of women’s labor rights situation was investigated, First, wedisaggregated and summarized the statistical data, and then we wanted to find the reasons ofgender discrimination and the damaged rights that appeared in the current femaleemployment process through a combination of survey data. Finally, we found that the reasonsare the physical differences of male and female, the influence of traditional culture, thegender losses in the economic and the problems of legislative model.From the problems and causes, and combined with the advanced legislative experienceof developed countries, we ultimately gave the legal and policy proposals, Not only theimprovement of relevant legislation, but also the establishment of specialized lawenforcement agencies to strengthen the enforcement of law, broaden the channels of reliefand strengthen relief at the same time.
