Research On The Legal Regulation Of The Use Of Food Additives

With the wide use of food additives, China’s modern food industryhas achieved great development. In order to make China’s food additiveindustry get sound development, China has issued relevant laws,regulations and standards, and launched a series of campaigns againstfood additive abuse. However, food additive abuse still affects ourcountry’s public health, safety and life. It urgently needs to get effectivesolution. Firstly, this thesis draws forth the problems to be solved in theregulation of the use of food additives which should be used inaccordance with laws in our country from the “Dyeing steamed bread”event. Then through comparing domestic and foreign laws and rules inregulation of the use of food additives, pointing out the present laws andexisting problems in the regulation of the use of food additives in ourcountry. Lastly, on the basis of learning foreign advanced experience inthis field and combining with the reality of our country, proposingcertain feasible suggestions to perfect the regulation of the use of food additives according to laws.This thesis is composed of five parts.The first part is introduction. This part introduces the significanceof selecting this subject, study review, study methods, and theinnovation of study.The second part is about the present laws that regulate the use offood additives in our country. This part points out China’s efforts in theregulation of the use of food additives by introducing the relatedcontents of laws and regulations China has issued, such as food safetylaw, standards for the use of food additives, and so on.The third part is about the legal analysis of food additive abuse inChina. This part includes the following three aspects: the imperfectionof current laws and regulations in China, weak law enforcement ofregulators, and other factors. Through discussing these three aspects,pointing out the reasons why food additive abuse still exists in China.The fourth part is about the observation of comparative laws in theuse of food additives. This part aims at obtaining advanced experience which is worthy of learning to China through discussing the relatedforeign laws of CAC, USA, EU and Japan.The fifth part is about legal suggestions proposed to perfect theregulation of the use of food additives in our country. This part proposessome legal suggestions, such as perfecting relevant laws, regulationsand standards, establishing a law enforcement and supervisionmechanism which is participated by multiple parties, and so on, on thebasis of summarizing the reasons which result in food additive abuse inChina and the advanced experience which can be learned from foreignlaws.
