Research On The Hu Shi’s Constitutionalism Thought

I attempt to discuss Hu Shi’s constitutionalism thought in thisdissertation, which is divided into four parts.The first part introduces thehistorical background,the second part introduce the origin of histhought,and then I will discuss the main content of his constitutionalismthought,which including democratic thought,idea of human rights,legalthought and thoughts about government and political party.Hu Shiconsider that democracy is a way of life,and he give extremely high creditfor democracy,but resist despotism.And he think that human rights needsguarantee of the rule of law.Freedom of thinking and expression is themost important human right.He also call for the constitution as soon aspossible,because constitution is the basic of the rule of law,thefoundation of the constitution is inferior to observation of the law.Thesoul of the law is practicing.At last,he advocate the idea of goodgovernment, say that there are two different political parties, wish to cancel the party rule,implements the constitutional government.Hu Shi’sphilosophy thought reflected that he is a liberalist,and he advocate themethodology of pragmatism.Hu Shi was born in1891.I divide thehistorical background into four parts.The first section is from1891to1912,many important events happened,such as the Sino-Japanese War of1894-1895, Hundred Days’ Reform,the Boxer Uprising,Coalitioninvasion of the g8,Russo-Japanese War(1904-1905),the Wu changuprising,The interim government of the republic of China wasfounded,which were happened in Hu Shi’s Young Age.The second sectionis from1912to1928,Long-term warlord regimes was over, China realizethe unification in form.The three section is from1928to1949,Theinterim government of the republic of China ruled the country..The foursection is from1949to1962,the People’s Republic of China wasfounded,Hu Shi escape from Peiping,arrive In New York,died inTaiwan.And the origin of his constitutionalism thought mainly influencedby his educations.The first part is the education in his hometown about9years.Hu Shi learn a suit of traditional education and atheism,and he went to study in Shanghai,in which he was influenced by Trends of socialthought.Books of Liang Qichao and Yan Fu,articles in The timesinfluenced him deeply.The student movement of the National Universityinfluenced him.And he once Published the newspaper.These experienceseffect him.And then He went to study in USA about seven years.Hereceived American political practices and learned sth about Publicspeaking.He also received some ideas,such as cosmopolitanism,pacifismand internationalism.Dewey’s experimentalism also influenced himdeeply.Hu Shi return to China in1917.He was employed by PekingUniversity,became a professor.Chen Duxiu and he waged the NewCulture Movement.Then HuShi Published Some journals,such as THEENDEAVOR,NEW MOON,Independent Review.He published lots ofpolitical articles.this paper will be in line with the objective position ofneutrality, combined with the specific historical environment at that timeto discuss the theory and practice without sedulous compliment andprejudice.I will be in line with the spirit of seeking truth from facts. Aminute of evidence, said a points words.I want to show the constitutionalism thought of intellectual in one period,and think about therealistic value.
