In The Perspective Of Government By Law,Administrative Enforcement Of Chinese Food Safety Issues And Countermeasures

Food safety is an important issue to human survival, as it not only relates to the people’s health, but also relates to the stability of the society and the development of the economic. However, the food security situation is not satisfactory. In recent years, a number of food safety incidents occur frequently, which do great harm to people’s health and safety. The basic requirements of human survival are difficult to be met, which serious affect the development of the food industry, and makes the public sense of trust on food regulators greatly reduced. The important reason of the high frequency of the food safety incidents is that has many problems in the administrative enforcement of food safety. So, in order to ensure the safety of our food and to maintain a healthy development of our food industry, it must strengthen the food safety supervision. Based on the theory of government by law, this thesis analyses the administration enforcement system, to find the problem of administrative enforcement of food safety, and then give some suggestions to strengthen the administrative enforcement of food safety.This thesis divides into five chapters:The first chapter is the introduction, has described the research background and the significance, the domestic and foreign research situation on this area. In addition, this section also states the writing ideas and research technique, as well as the research content and innovation.The second chapter is the theoretical explanation of the administrative enforcement under the rule of government by law. By analyzing the connotation of the government under the rule of law, combined with the relevant literature, to define concepts of administrative enforcement of food safety.The third chapter is the current leak in administrative enforcement of food safety in our county. By analyzing the administration enforcement system of food safety, combined with questionnaires and case studies, to identify the problems in administrative enforcement of food safety, including problems in basis of law enforcement, problems in system of administration enforcement, problems in enforcement operations, problems in enforcement responsibility, etc.The fourth chapter includes suggestions to improve the administrative enforcement of food safety. Aim at the main problems of administrative enforcement of food safety, combined with our actual conditions, to give some suggestions for improving our administrative enforcement of food safety, including suggestions for improving the basis for food safety enforcement, improving the system of food safety enforcement, optimizing the operations of food safety enforcement, enhance protection for food safety enforcement, and strengthen the supervision on food safety enforcement, etc.The last chapter is the conclusions of the thesis and the future prospects for the administrative enforcement of food safety.
