The Economic Law Regulation Of Chinese Marine Resources Development And Utilization

On the economic law regulation of Chinese marine resourcesdevelopment and utilization, was divided into four part: thetheory of economic law regulation of marine resourcesdevelopment and utilization, economic law regulation of mainbody of Chinese marine resources development and utilization,economic law regulation of rights and obligations of Chinesemarine resources development and utilization, basic path toeconomic law regulation of Chinese marine resources developmentand utilization. The perspective of economic law of developmentand utilization of Chinese marine resources, is the footholdand main characteristics of this paper.The first part is about the connotation, social values ofmarine resources development and utilization and itsrelationship with national regulation. First, paper came to theconnotation of marine resources development and utilization,by defining the different context of it and logic relation.Thenthe paper analyzes the social values of marine resourcesdevelopment and utilization, and its relationship with stateregulation. At the same time, the paper explore state regulation theory, social standard theory, constitutional theory of theeconomic law of marine resources development and utilization,to suggesting that marine resources the development andutilization in the interests of the whole society as the pursuitof value, needing country to carry on the adjustment andconstitutional constraints idea of economic law idea. Finallythe paper put forward that marine resources development andutilization need the regulations of economic law.To undertake the front, the paper analyzed the law relationof marine resources development and utilization as the clue ofarticle, combining related behavior object, mainly elaboratedthat the main body and the rights and obligations of economiclaw regulation of Chinese marine resources development andutilization. Then the paper put forward that main body ofeconomic law regulation of Chinese marine resource developmentcan be classified as main body of decision making, managementmain body, main body of economic activity, analysis theirqualification regulation problems. Finally, paper analysed theregulation of industry associations and non-profit organizationof Chinese marine resources development and utilization. Therationality of existence of three path can be traced back to the regulation rationality of the market regulation law, macrocontrol law, national investment operation law for marineresources and regulation development and utilization. Furtherthe paper investigated the status the three path of Chinesemarine resources development and utilization, then researchedthe problems of the three path to perfection and development.
