Research On Chinese NGO Legal Regulation

The NGOs are developing rapidly around the world with the rise of public governance theory and practice in the global. They play an irreplaceable role in promoting social democracy and legal construction, stabilizing social order and completing market operation mechanism, etc. Since China’s reform and opening up, the NGOs in China have also made rapid development, they play an increasingly important role, which are mainly reflected in providing effective public service, assisting the government management, promoting social progress and so on. But NGOs’development still lags behind the development of society and economy, and they often violate the public interests. Compared to the legal regulations of the NGOs in some developed countries, China’s NGO regulations are relatively falling behind the needs of the development of NGO. It mainly because there are only a few NGO legislations that are still in a low level; various contradictions and conflicts are in the laws, and there is great lacks of unified and specialized laws and regulations on NGOs; no legal protection on the supervision and management, legal relief system of NGOs, etc.Based on the analysis of NGOs in our country and the basis of legal regulation problems, Article analyzed the cause of the special law regulation on NGOs. First of all, the NGOs play multiple roles in social life, such as administrative, civil and commercial subject and general managers. The role of these complex causes to special legal regulations on NGOs. Second, Caused by the interference of the government to NGOs, they lack independence and autonomy, can’t play their function. Therefore, we need to through the legal way to establish the independent status of NGOs. Again, the deficiency of NGO itself needs to compensate by laws and regulations. Finally, international NGOs are crowding into our country, most of which organization has positive influence on the social and economic development in our country, but there are still a few NGOs in illegal activities, so we need to special law regulating international NGO in China.In using the experience of NGOs in the developed countries and combining with China’s national conditions, the author put forward the build scientific and perfect NGOs legal regulation system of specific recommendations. These Suggestions include changing legislation guiding ideology, NGO legislation should be perfected; Reform the management system, innovate the supervision mechanism; Build the legal relief system of NGOs and their members. Through the above measures to actively guide NGOs healthy and orderly development, promote the perfection of China’s public governance mode and the course of the construction of democracy.
