Study On Law Regulation Of Chinese Nongovernmental He-Hui

“The economically liberal people help the people who with a shortage of economic in time of emergency,someone to help others,others will surely repay;this is the purpose of the He-hui since the ancient times”.Wang Zongpei described the He-Hui in his book.The nongovernmental He-Hui is a kind of nongovernmental economic cooperate custom which is on the basis of consanguinity and geography and use credit as constraints.It has a long history and popular in Chinese face-to-face society.It has the functions of saving and financing,and nowadays it still plays an important role in financing in many areas in our country,especially in the coastal countryside.But the nongovernmental He-hui tends to be bad in today's abnormal prosperity commodity economic conditions.Its limitations exposed constantly.It has caught people's attention to control the risk due to the storm of “Dao-hui”.People calls for strengthening the regulation of He-hui' risk.Face to the voice of the people,the authorities should take its social responsibility,and it is necessary to take the appropriate legal action to supervision and regulation of the nongovernmental He-hui.The nongovernmental He-hui is the core subject of this paper.Firstly,this paper introduces the related basic content of the customary law and the nongovernmental He-hui.Secondly,the paper illustrates the necessity of appropriate legal regulation to the nongovernmental He-hui by analyzing the importance of the nongovernmental He-hui.Finally,it will put forward the idea of legal action to supervise and regulate the nongovernmental He-hui according to the analysis of the He-hui' practical problems and the cause of the problem.This paper mainly includes the following seven parts:The first part is introduction.Introduction will mainly briefly introduce the background and the purpose of the study.The second part will briefly introduce the customary law that is the essence of common law.Then,it will introduce the concept of He-hui and its operation mode.Besides this part will also introduce other matters about He-hui,include the origin and development of He-hui,legal nature of He-hui,and so on.The third part mainly introduces the value of legal actions that takes to supervise the nongovernmental He-hui.The fourth part will summarize the indirect legal basis of china's the nongovernmental He-hui and the present situation of administrative rules and regulations and judicial practice.The fifth part describes the problems of the nongovernmental He-hui in our country and analyzes the cause of such problems from the perspective of social,economic and legal supervision present situation.The sixth part will puts forward the idea of legal action to supervision and regulation of the nongovernmental He-hui.It emphasizes that the authorities should leave enough living space to this precious local resource while take actions to supervise and regulate the nongovernmental He-hui.Besides,it will recommend take classification management and for the record registration system,set up private information publicity system and establish a system of joint conference and so on.The seventh part is conclusion.
