Food safety is an important public health problem in a relationship to the health of residents in China, but also solidarity with the people’s livelihood. However, in recent years, China’s food security problems have become more serious.2004"giant calcium hydrogen peroxide event the borax flour event in2006, clenbuterol event, apple snails and nematodes event, Sudan incident, crabs carcinogenic event, stale rice event, turbot fish event, the2008melamine milk powder incident greatly hurt the interests of consumers. This series of food safety events, not only harmful to the health of our people more influence China’s social stability and harmony, but also exposed the contemporary food safety legal system in China is still flawed. Therefore, the strengthening of food safety is significance.Its inherent complexity and comprehensive food safety issues, but part of the legal system is essential to build a food safety assurance system and plays a extremely important role. This paper attempts to explore aspects of the legal system of China’s food safety role and mechanisms to ensure food safety through the comparison of Chinese and foreign food safety legal system, and concludes with recommendations to improve food safety in China’s legal system.The paper is divided into four parts:the first part, an overview of food safety. Elaborated the concept of the food safety, food safety relative issues, and its connotations. The second part of the legal system of about the foreign food safety. Mainly related to the legal system and the experience of foreign food safety. The third part of the legal system of China’s food security status and limitations. The status of the legal system of China’s food safety and shortcomings. Specifically addressed the state legislature to develop the core legal and administrative regulations, departmental rules and regulations. At the same time, the limitations from the legal system, regulatory system, the standard system, inspection system, certification system, information disclosure system, six aspects of discourse of food safety in China.The fourth part is the improvement of China’s food safety laws and regulation. It is the core content of the full text. Include the following:First, improving China’s food safety laws and regulations system; improve the food safety regulatory system, including at this stage to improve food safety regulatory system, improve food safety regulatory standards and improve the responsibility system and clear accountability; third is to improve food safety related legal system, including to improve food quality and safety market access system to improve the recall system and improve the information disclosure system; four supporting measures to improve food safety legal system, including advocacy for social ethics and ecological ethics, the implementation of corporate social responsibility and the implementation of compulsory liability insurance related to food safety. This section made several suggestions for how to improve the legal system of China’s food safety, and beneficial to China’s food safety legal system.
