Construction engineering is professional field which is a time consuming and energetic focused as well as propensity to conflict. The conflict or argument is one of the key characteristics in the area. Mediation is a flexible, cost-effective and non-antagonized conflict solving method. Mediation is a dynamic process. During the mediation, mediator needs to choose the adequate strategy to help both the defendant and offender to reach agreement based on the different scenarios.This research project firstly focused on the frequently observed model which includes litigation, arbitration and mediation, and which elements are involved in the model such as the objective condition, subjective community effect, advantage and weakness. Also the analysis of these factors was applied to the model and its adaptability.Secondly the research investigated the behavior on the both side of the conflict. For example, on the mediator side, there some key factors are discussed such as process preparation, suggestion degree, behavior validity, conflict solving expectation and required quality of the mediator. On the other side, there are some elements are important to reach the agreement which include statement preparation, evidence affirmation, information sharing and privacy degree management.Lastly all the relevant elements and models applied to some case studies to test its validity.
