Protection Of Consumer Rights On Our Country Food Safety Incident

Food security is closely related to public life. Currently, the high incidence of food safety issues, has raised concerns about food security, food security has become a hot topic. To this end, my Government attaches, constantly strengthening the food safety legislation has been building,putting the law enforcement supervision and Management Department of the Division of responsibilities,establishing food security early warning mechanisms,legal barriers have been erected for the protection of consumers of food security,provides system protection.However, the real life of operators in a strong position compared with the disadvantaged position of the consumers, operators and consumer transactions are always a professional and non-professional, inside man and the relationship between non-insiders, most of the operators know about technical characteristics of the product, know the market, understanding customer psychology, has a skilled sales techniques. And consumer, often comparison lack on purchase merchandise and accept service of related knowledge, cannot full, and real to master consumption information, makes in food security event in the against consumer interest of event award-winning has occurred, consumer interest protection also exists many problem, such as, the rights difficult problems consumers experienced food security, consumer organization in maintenance consumer interest of role difficult to play of problem, these problem became restricting in China food security event in the consumer interest protection of important factors.In view of this, the paper is divided into four parts to start on:The first part introduces the concept of food security and food safety in China’s legal system, and around China’s food safety events to elaborate on the interests of consumers.The second part of the combined case analysis of the status quo of China’s food safety incident Consumer Protection, introduces the "Food Safety Law" and the role played by the Consumers Association of Food and Consumer Protection. At the same time, combined with the actual, discusses the "Consumer Protection Law" in the event of food safety to protect the interests of consumers there.The third part of the United States, European Union, Germany, Japan and the protection of the interests of consumers about food safety incidents practical experience, in order to obtain the protection of the interests of consumers in China can learn from.The fourth part is based on the analysis in the previous issue, to make recommendations on how to better improve China’s food safety incident Consumer Protection, including perfect "Consumer Protection Law" proposals to improve the problem of food recall system, consumer Protection relief ways to expand, and the cultivation of the concept of rule of law.
