Under The Guidance Of Marxist Religion, The Religious And Legal Construction In China

With the methodology of historical materialism, Marxist view ofreligion deep reveals the essence of religion and religious, what is theroot causes of religion and religious social role and function, andreligious development and die out. Marxist view of religion is thefundamental theoretical basis of the construction of religious legalsystem now.On the basis of them,this paper attempts to make a systematicstudy of the China’s religious legal system construction, taking thesocialism harmonious society as a background and guiding by Marxist viewof religion.Firstly,this paper analyzes the theoretical and practicalbasis of the China’s religious legal system construction.In which,weintroduce some concepts about construction of religion and legal system,the harmonious society’ putting forward, and the meaning of harmonioussociety.We analyze roles of construction of the religion and legal systemin harmonious society specially.Secondly,we summarizeachievements,fundamental experiences and existing problems in theconstruction of religious legal system. Guiding by Marxist view ofreligion,the last chapter proposes some conception of improving thereligious legal system，which can provide beneficial references for theconstruction of religious legal system of China.
