Closed Or Opening: The Constitutional Analysis Of People’s Congress Representatives Studios

Our deputy to the representatives of People’s Congress shall perform their duty in accordance with the laws and regulations. This is an important part of our People’s Congress System, and plays a significant role in improving such system, and safeguarding the democratic rights of people as the master of our country. In this new age, the studios of our deputies to People’s Congress are the emerging exploration for our deputies to carry out their job. However, they encounter a series of controversies over their flourishing and operation. And seldom people can reach an agreement with regard to the aforesaid issues. Here, the author also makes an analysis to those problems, and considers the reason lies in an ambiguous definition of those studios. Therefore, the author tries to hold an analysis on the models of those studios, and develop his argumentation based on the analysis.An exploration to the constitutional meaning hiding behind those studios is very helpful to facilitate the exploration and improvement of democratic constitutionalism. Starting from our basic systems and fundamental realities, and relying on the constitutional hermeneutics, the author tries to analyze and comb a series of similar instances, based on the subdivision of different models for those studios. And concentrating on two core topics reflected by such instances——the relations between deputy and electors and performance mode of our deputies, this paper launches a discussion on constitution, makes efforts to explain the advantages and disadvantages therein, clarifies the relations between them, and elaborates the connotation deeply. Although the doors of studios of our deputies have been closed, the windows are still open in a broad sense. And they have accumulated rich experiences during their practice. What’s more, the author also points out that the new revision of Law of People’s Republic of China on Deputies to the National People’s Congress and Deputies to Local People’s Congress denies the attempts of full-time deputy harshly, with a likelihood of policy-induced legislation. At last, the author fully confirms the significance of such revision, reminds us some insufficiencies during our revision of laws, and gives his own suggestions on legislation.People’s Congress Representatives Studios are the spreading and the stretching of the democracy under the new period, that is, the development of democracy objectively has chosen these performance ways. They are the carriers or tools of performance duty, having nothing to do with the performance duty way. The author takes the studios of our deputies as his foundation and clue, and puts different encounters of various studios throughout his paper. And through a constitutional analysis and helpful exploration, the author hopes to benefit the development and the consummation of our National People’s Congress System and better our protection of the implementation of the idea of democratic constitutionalism.
