Reasearch On Chinese Legislation Of Foreign Skilled Immigrants

Attracting foreign skilled immigrants is one of the methods for the implementation of the talents strategy of the counties, so legislation of foreign skilled immigrants is crucial to every country’s immigration law. China also paid more attention to the legislation of skilled immigrants gradually. However, our understanding of skilled immigrants, the situation and trend of skilled migration law, our country’s advantages and disadvantages in attracting the international talents had deviated for a long time. Therefore, the established laws and legal system had obvious problems in macro structure, legislative idea, system design, and other aspects.In order to enhance our country’s the overall national strength, China should build more attractive immigration laws, policies and systems to have a place in the fight about the talents competition. In the first part, this paper reviews the current policy documents and the relevant immigration legislation in our country and points out several problems in the existing laws. Part Ⅱ introduces the skilled migration laws and legal systems not only in typical immigration countries such as the United States, Canada and Australia, but also in similar counties and regions like Germany and Hong Kong. In the third part, based on Part Ⅱ, we draw a legislative outlook of the Chinese skilled migration law and the reform trend of the relevant legal system.This thesis innovates in the following points:1. Legal exploration of foreign skilled immigrants is rare in existing domestic research;2. Skilled migration is a legal problem but also involves various aspects including international interest and so on. The design of the skilled immigration system should take political factors into consideration;3. In comparative study, the author focuses on the conflicts and fusions of China’s national conditions with the advanced experiences in other counties, so that the new legal system can be designed with Chinese characteristics.
