Economic globalization makes the rational flow of global resources, the population also move with because of the flow of resources, many developed countries dominate the world more resources, but do not have enough labor to proceed with production using the resources reasonably. China as the world’s fastest growing countries today, the human resources market is changing so much, due to the rising cost of living, China labor cost is also in constant increase, in national policies introduced gradually, low-end labor wages rise quickly, thus, the\"employment\" and\"hire difficult\" phenomenon, some not in the Labour market supply and demand balance, especially during the harvest season, most migrant workers back to receive food, caused the factory to a serious shortage of labor, surrounding low-income countries such as Vietnam, Burma, north Korea labor was poured into working illegally in China at this time. In addition, in recent years, our country has been reported that college students difficult employment news, college students go home stalls of news, this means that the employment resources of our country is not enough to admit more foreigners, our top priority is our domestic employment pressure.In this background, this article mainly USES comparative analysis definition, the employment of foreigners in China from the international and local labor laws to define, secondly the present situation of the employment of foreigners in China were analyzed, and grasp the existing contradictions, compared to the existing management system of employment of foreigners in China, which can’t conform to social development, seeking to perfect management of foreigners in China employment legislation.Throughout the full text, in this paper, according to China’s national conditions, considering the foreigners in China employment management is beneficial to the economic development of our country, so want to be able to draw lessons from foreign experience in legislation, to our country main problems of current related law or policy documents to conduct a comprehensive analysis, based on this to find suitable for alien employment management system in our country, we want to be able to absorb more high-end talent to employment in our country, at the same time, more to ensure the full employment of labor, it is the duty of the state, the first in the security obligations at the same time in order to use their own rights.
