| Due to involving with many countries and areas and theirs complicated legal circumstances, personnel and equipment, military action, and foreign influences of United Nations peacekeeping operations are closely related to national sovereign rights and benefits. Only by strengthening the construction of legal guarantee for peace-keeping operations, can the legislation be regulated to promote the peace-keeping operations scientifically and orderly.This paper proceeds from the basic situation, the significance and the legal guarantee of China’s participating in the United Nations peacekeeping operations. And it deals with strategic importance and urgency of strengthen the construction of legal guarantee of China’s participating in the United Nations peacekeeping operations, so that the needs for detailed legal guarantee of United Nations peacekeeping operations were raised. Based on the analysis of current situation of China’s participating in United Nations peacekeeping operations, it deeply revealed deficiency of the legal system for peacekeeping operations and lagged legislation. The mature mode of legislation construction in western developed countries provided the useful experience to strengthen the construction of legal guarantee of peacekeeping operations in our country with a purpose.Finally, improvement of the legal guarantee for China’s participating in United Nations peacekeeping operations is investigated from four aspects:construction of general thinking of the legal guarantee, establishment and perfection of the legal guarantee system, formulation scientific and reasonable regulations, and improvement of detailed measures of legal guarantee. The theoretical model of peacekeeping legal guarantee is put forwarded preliminarily and innovatively, involving the organization, operating mechanism, principle and legislations. And the detailed measures were proposed to explore the construction of legal guarantee system of China’s participating in United Nations peacekeeping operations. |
