Effective Operating Mechanism Of Audio And Video Recording In The Public Security Organ

Unjust cases occur frequently in judicial practice. The reason why unjust cases occur is the extort confessions by torture. The extort confessions by torture will not only cause serious damage to the modern legal system, but also easy to cause many adverse consequences, such as violation of human rights dignity, damage the judicial authority, etc. Torture of governance has been going on, but the result is not ideal. Due to its function in containing the extort confessions by torture and safeguarding human rights, audio and video recordings get lots of national attention.The amendment of criminal procedural law in2012included audio and video recording system for the first time. Before that, audio and video recordings have been used in the interrogation of a criminal suspect of the public security organ. After the final established of audio and video recording system in law, how to make it run efficiently has become the top priority. This paper is aimed to analyse the difficulties when the public security organ bring audio and video recording into effect, and then study the effective operation mechanism of audio and video recording system in public security organ interrogate suspects on the basis of foreign experience.
