Research Of Legal Problems On The Land Guarantee Of Small-town Construction

Since the reform and opening up, small-town construction in China ushered a rare historic opportunity, with developing rapidly, and has played a great role in promoting on all aspects of the social economy in our country. It is a great strategy in social and economic development to expedite small-town construction. Small-town construction is an important content of the new urbanization path, is an important way of promoting the harmonious development between urban and rural areas, is the inevitable choice for China to expand domestic demand, and is conducive to achieve a well-off society overall. But, with the rapid development of small towns, the number of small towns is growing, then the land demand of small-town construction will be increasing. Because a large population with relatively little land is our country’s fundamental realities, the contradiction between land utilizition of small-town construction and the scarcity of land resources will continue to exist for a long time. How to guarantee a reasonable land supply and utilization of land in small-town construction, to ensure the land demand for small-town construction and the rational development and utilization of land protection, is one of the key problems in small-town construction with a rapid and healthy development. So, in order to accelerate small-town construction, must deal with land security problems in small-town construction.This article from the perspective of law analyse the land security problem in small-town construction. Full text is divided into four parts:The first part, the introduction mainly introduces the research background, research purpose, research significance and research method.The second part, outlining small-town construction and land guarantee, including defining the concept of small towns and small-town construction, the positive significance of the development of small towns in china, and analysing the relationship between small-town construction and land guarantee etc.The third part, analyse China’s current legal system of land guarantee’s contributions to and impacts on small-town construction. From analyzing characteristics of land utilizition, present situation and reasons of our small-town construction, clarify the land guarantee needs legal mechanism in small-town construction in our country. Based analyzing the contribution of the current land legal system to land guarantee of small-town construction, put forward the defects of current land legal system in small-town construction.The fourth part, analyzing the problems is finally to properly solve problems, so the author proposes the concept of improving the law mechanism of land guarantee of small-town construction of small in this part. The author mainly put forward four proposals for improving legal mechanism for land guarantee of small-town construction:improve the legal system of land guarantee, improve the interest of assuring mechanism for landless peasants caused by the land guarantee, improve the mechanism of settling land disputes and punishing land violations in the process of land guarantee and enhance the legal consciousness of peasant land rights and interests, and improve the social supervision mechanism of land security.
