Analysis Of Optimization Of Local Urban Rural Planning Regulation

The introduction and implementation of Urban and Rural Planning Law of the People’s Republic of China defines the basic principle of urban and rural planning work, and at the same time establishes the mainstay of all planning work. However, for the specific operation in reality, these systems are prone to have too much principles, needing regulation and implementation laws that suits different districts so as to meet the need of all places. Therefore, it is necessary to make the spirit of Urban and Rural Planning Law as premise, and combine local features to formulate a series of local regulations according to Legislation Law of the People’s Republic of China, so as to construct a multi-level and systematic planning regulation system.This article selected some planning regulations of urban and rural from several representative regions, which not only included both municipalities and the capital city, but also some cities regarded as the18larger cities, which are approved by the State Council in accordance with local organizations. This city basically covers various types of local legislative city. At the same time, this city not only included some more developed city with high level industrialization and urbanization, with strong economic base and strong ability of regional radiation, but also included some second-and third-tier cities which still on the way of rise and development. Furthermore, these cities are situated in the east and west of our country in all directions in geography. Among the local urban and rural planning regulations made within5years ago, this paper chose several local regulations that are typical and make comparison and analysis among them as regard for their planning main body, procedure, evaluation and modification. Problems such as lack of combination with upper-level legislation, weakness in laying stress on local conditions, loss of the main functions, deficiency in public participation were pointed out. In addition, suggestions about spirit of regulation, entity of regulation, procedure of regulation and the legislative techniques were put forward so as to further regulate the planning work. On the one hand, it will helping to building the knowledge economy and innovation city, promoting social coordination, improving the quality of life of residents and the protecting the city’s sustainable development. On the other hand, it will help to break the dual urban-rural structure, to promote the free movement of factors of production, population, public services. So that we can reach the goal of building a new urban-rural relationship "industry nurturing agriculture""cities support rural" and earnestly safeguard the fundamental rights of the farmers and expand its space for develop economy.
