Study On Local Legislation Of Epnvironmental Governance In Urban And Rural Areas

China's long-standing urban and rural two yuan environment structure,make our country's urban environment improved better,while China's rural environmental protection has been neglected,With the development of China's urbanization,the pollution of the city to the countryside,the rural environment is no longer the green mountains and rivers and blue sky and white clouds,the rural living environment by pollution,destruction of ecological environment,the quality of life in the fall,to the governance of rural environment,the city environment and rural environment system as an organic whole,coordinated development.With the acceleration of urbanization and city industrial pollution in rural areas to transfer rural environment pollution is hitherto unknown,life pollution,industrial pollution,chemical fertilizer,pesticide and plastic film pollution and ecological damage environmental pollution and ecological damage.As a whole,the governance of rural environment is related to the overall development of the rural economy and society.It is related to the environmental development rights of rural villagers,and is related to the balance of urban and rural environment development.It is also related to social harmony and stability.According to theory of social division,along with the development of productivity,the social economy is more and more developed,more and more detailed division of labor,the legal adjustment of social type "solidarity" division is mainly "the cooperation method",the relationship between the rules of the adjustment of industry interests.Urbanization is the result of the continuous development of social division of labor,represents the development of market economy,is a social joint and several relations,and is the result of the development of contract economy.If the city interests mainly embodies the "solidarity" division,emphasis on industry,sector and opening,is horizontal flat interest,so rural interest relations reflected "with the relationship",emphasis on regional and closed,is vertical interest.The process of balancing urban and rural environmental governance is the process of coordinating urban and rural areas,departmental interests and local interests.The local environmental legislation is to adjust the complex relationship between the interests of the industry and local interests.The theory of division of labor and the theory of good governance provide theoretical support for local legislation.How to closely link the horizontal and vertical(urban and rural)in the environmental legislation and achieve the harmonious coexistence between the two are the problems that need to be solved urgently in our country.Among them,the contradiction between urban interests and rural interests,industry interestsand local interests,industry interests and industry interests is particularly prominent.In environmental legislation,solving these outstanding problems has become the focus and difficulty of legislation.The author carries on the investigation to the city of D in the analysis,made in the urban and rural environmental governance in the achievements,but also found in overall environmental problems in the course of treatment.Analysis of the causes of the differences between urban and rural environmental governance from the perspective of local legislation,is mainly due to local legislative defects lead to the differences between urban and rural environmental governance,the defect of local legislation in the following aspects:Local environmental legislation is lack of local characteristics,environmental legislation system is not perfect,department interests and local protectionism is prominent,interest coordination mechanism is not perfect,the constitution supervision system of local environmental legislation is not perfect.Aiming at the existing problems in the local legislation,local legislation of urban environmental governance in China and puts forward some opinions:Improve the environmental legal system of urban and rural areas;improve the environment of deliberative governance mechanism;fill legislative gaps;coordinate the relationship between the industry and local interests;clarify the central and local legislative authority;the establishment of urban and rural environmental legislation and the coordinating mechanism of the interests and the local legislation of constitutional supervision system.Balancing urban and rural environmental governance is an important part of urban and rural integration in China.Only by balancing the interests of urban and rural areas and changing the existing two urban and rural structure,can we achieve comprehensive,coordinated and sustainable development of urban and rural areas.
