Research On The Status Of The Rural People’s Mediation In Anhui Province

Rural people’s mediation plays an important role in mediating minor disputes, resolving contradictions among the masses, and maintaining and promoting social harmony and stability. The three all—he growth of mediation team, the improvement of the quality of mediation and the increase of mediation case quantity,—roves the work of rural people’s mediation has been to a higher level, especially after the People’s Mediation Law was enacted. The people’s mediation is very suitable for solving rural disputes because these are minor disputes. Many of these disputes are based on family relations or neighborhood relations. It will be great helpful to ease the relationship between the both parties, and this "no-resorting-to-court" solution is also conform to the "evil lawsuit view" of the rural society. Rural people’s mediation not only saves a lot of judicial resources, but also saves costs of the parties because of its convenience and quickness.I myself took an active part in the people’s mediation work, when I interned in the Judicial Bureau of Xiuning County. I conducted a comprehensive analysis on the causes of disputes, mediation program, results of dispute mediation, and performance of mediation agreement. Through the survey of ten months, I deeply aknowledge advantages of the rural people’s mediation and its necessity for solving disputes in the rural society. And at the same time,I also found the problems and shortcomings of the rural people’s mediation. For example, the lack of relevant laws and regulations leads to no systems for mediation work depending on; local government and departments confuses the "multiple mediation" with rural people’s mediation, which makes the rural people’s mediation exists in name only; the lack of special mediation fund makes the mediation work harder; the professional competence and overall quality restricts the improvement of the quality of mediation work; not all mediation agreements can be performanced, and mediations and lawsuits haven’t been conncted to each other. All these problems influence the rural people’s mediation work and limit the development and perfection of this system.The innovation and characteristics of my article is that I carried out an investigation on the local people’s mediation work, collected data, participated in mediation. So I know about the development of local rural people’s mediation and the problems. Rural people’s mediation has obvious characteristics of grassroot, folk and masses. By means of investigating the local people’s mediation work, I can better grasp the mass base of the system and the necessity of this system.
