Public Participation In Local Administrative Legislation Research

I studied and compared the foreignexperience of public participation in local administrative legislation, summed up thepart have guiding significance to our country. I systematically organize the laws,regulations, rules of every provinces and cities′public participation in rulemaking. Andanalyzed its practice, find out the deficiencies in legislation and practice in our country.Absorb advanced foreign experience and on the basis of combining with the actualsituation in our country. Put forward suggestions of perfecting our country’s publicparticipation in local administrative legislation.Local administrative legislation has strict legislative process, in this paper, theimprovement of the mechanism is follow the legislation system design. In preparationfor the legislation, establish the system of legislative initiative; In the legislative reviewstage, to improve the system of legislation of public, to perfect the public participationrights safeguard system, promoting the legalization degree of three main way ofparticipation. The assessment phase after legislation, establish evaluation afterlegislation system.Better public participation in the local administrative legislation is not in one day can finish, I hope this article can be public participation in local administrativelegislation in the future play a guiding role.
