In recent years, China’s urbanization is an accelerating trend.. A lot of rural land problems along with a new vulnerable groups-landless peasants have occured.We say it is the vulnerable groups.Because of land acquisition,the person’s employment rights, labor rights and other civil rights have constantly been violated, causing them to become neither land nor work, no social security social refugees.Enjoying social rights which are stipulated in laws is an inevitable requirement in a democratic society, And it is also a measure which can measure the degree of democratization for a society. The Constitution of the People’s Republic of China which is the most authoritative regulations, provides o lot of rights for its people,however, people has not enjoyed.The landless peasants’ rights,for instance, The right to political participation, The right to social security and employment right are not guaranteed. The real ought problem, mainly due to three aspects which are rural land property rights system, the problem of land requisition compensation system and landless farmers themselves. Learning from the practice of some foreign countries, combining with the cause of the problem of the landless peasants in china, this article provides some suggestions based on the rural land property rights system, the social security system for land requisition compensation system and landless peasants to safeguard the civil rights of landless peasants.For rural land property rights system, we must first define the property rights of rural collective land property and people on behalf of their rights,.only in this way can we make the problem more clear and make the suggestions more operable. Specifically, the collective property rights belong to the rural collective.And make the economic organizations as a representative of the property rights of rural collective land so that the farmers of the village level. So it can avoid Overlapping functions because of too many subjects. Also we must make ti clear which are the rights belong to the economic collective. So we must give more rights to farmers, in particular, allow farmers have the right to use the farmland for non-agricultural use. Secondly, there is also a need to stabilize the land contract rights, to extend the land contract period, to avoid the disposal of land randomness. For land acquisition compensation system, making land acquisition purposes, land acquisition procedures and compensation for land acquisition more fair is important. Programs should be open, Compensation standards should be reasonable, to complete the project, and earnestly consider the long-term livelihood of the landless peasants. Ensuring the landless peasants’ Social Security, the three aspects of sources of security payments, operators, regulators to protect the content determination should be considered.I believe that a lot of political and social problems can ultimately be attributed to rights issues.The purpose of social development is for the interests of the people, and everyone has the inalienable right to life and the right to development, which is recognized by the world today. Various problems is due to civil rights have not been realized. Before writing this paper, I found that most people talk about the problem of landless peasants, from the point of view of maintaining there interest. And the government has implemented preferential agricultural policies which are more focused on the interests of the people also. In fact, the imbalance in the distribution of benefits, is an imbalance of power and rights. Rights is the protection of the interests and the interests is a manifestation of the rights.the interests is surface and is changing rights is fundamental. Safeguarding the rights and interests will be solved. If the rights are guaranteed, even if the interests are infringed is only temporary. Frome concentrating on interest to concentrating on rights means the society is more formal. Interests sought to rely "good" government.The protection of the right to relys on a proven system, as is said, a good government can only make a rich generation but a good system can benefit generation to generation, so that rights are critical for solving the problem of landless farmers. And it is the difference between this article and any others.In addition, the rights of landless peasants have been infringed, the important point is that the issue of land property rights system in China.
