Research On The Protection Of The Rights And Interests Of Landless Peasants In The Process Of Urbanization

At present, a large number of lands were expropriated with the acceleration of the urbanization, and an increasing number of peasants became the new vulnerable groups which called landless peasants who have no land, no job, no insurance and no money. Urbanization is closely associated with the landless peasants, and its development will damage the interests and rights inevitably. The damage of interests and rights of landless peasants in urbanization is not only an economic problem but also a social and political problem. Landless peasants, the special group, whose rights and interests cannot get effective protection result from the unclear property rights of rural land, the unreasonable rural land expropriation system, the unsound rural social security system, the landless peasants’own factors and improper exercise of administrative power of the government and so forth. So, the social problem is more and more serious. The protection of the rights and interests of landless peasants has become the primary problem and a pressing issue of solving it.The paper adopts literature analysis, normative analysis, system analysis and other analytical methods, combing the current situation and problem and multi-dimensional analysis on the reason of the damage to the rights and interests of China’s landless peasants while urbanization, puts forward the suggestions on protection of the rights and interests of landless peasants in urbanization.In addition to the introduction, the thesis is mainly divided into four parts.The first part elaborates the related concepts and theories of the protection of rights and interests of the landless peasants in urbanization.The second part states the development of urbanization in China and the status quo of rights and interests of the landless peasants in urbanization. The development of urbanization is divided into two parts, which are the period from the beginning of the founding of The People’s Republic of China to the reform and opening up and after the reform and opening up. The status quo of rights and interests of the landless peasants is introduced from the balance of payments, employment and social security conditions.The third part analysis the reason which caused damage to the rights and interests of landless peasants in multi-dimension, which are mainly the unclear property rights of rural land, the unreasonable rural land expropriation system, the unsound rural social security system, the landless peasants’own factors and improper exercise of administrative power of the government and so forth.The firth part puts forward suggestions on protection of the rights and interests of the landless peasants more effectively combing the status quo in China, so as to fully safeguard the rights and interests of landless peasants, social stability and build a harmonious society.
