The Research On Juvenile Delinquency And Prenventive Solutions In Chizhou Anhui Province

In recent years, juvenile delinquency has been committed more frequently in China and it has become one of the common concerns in the society. Many experts and scholars put their efforts on how to prevent and control juvenile delinquency and lots of countermeasures have been proposed. By viewing the juvenile delinquency committed in Chizhou during the past five years, this paper attempts to explore preventing and controlling solutions to juvenile delinquency in accord with Chizhou’s conditions.The paper contains three parts. The first part aims at clarifying the definition and connotation of China’s juvenile delinquency, and with the statistics, it summarized seven characteristics of Chizhou’s juvenile delinquency in the last five years. For instance, juvenile delinquency takes a number of amounts of the entire crime and is committed more frequently; the criminal age is becoming lower and lower and more and more juvenile criminal gangs come out, which shows a gangland nature; the type of juvenile delinquency is relatively focused and the achieving means is much simple, adult-like and violent; more light punishment has been carried out for juvenile delinquency; without enough legal awareness, the minors commit crimes with very simple motivation and tend to return to a second crime. Beginning with these characteristics, sums up the causes of juvenile delinquency in family, social, school and personal aspects. For instance, the lack of family education and the influence of poor family and mal-family; the negative effect of bad social culture and contagion as well as the lack of social and judicatory mechanism; the pursuit of rate of admission into higher schools, neglecting legal education, moral education, necessary juvenile instruction and sex education; the influence of physical and psychological element of the juvenile phrase. The second part mainly summarizes the criminal punishment for juvenile delinquency in Chizhou. including ensuring the legal rights of juvenile criminals; taking light punishment against them and the type of juvenile delinquency decided being focused. beginning with the preventing solutions already carried out in Chizhou, including the measures adopted by educational administrations, such as promoting competence-oriented education and carrying out special educational activities; preventing the crime in light of particular persons, times and locations. It also includes the preventive solutions of judicial administrations, such as combining punishment and education, selecting a particular person as the juror and tutor.the third part proposes some more suggestions to perfect it. Firstly, enhancing the instruction of the minors so as to prevent crimes by themselves, strengthening family education and making families taking the preventive role, balancing the educational resources and developing the qualities of teachers, enhancing the communication between parents and schools, insisting home visit programs, purifying the social environment so as to decrease the incitement for crime, improving the administration of autonomous mass organizations at the grass-roots level and establishing the preventative network against juvenile delinquency and finally attaching more importance to the education and resettle work of juvenile criminals. Secondly, raising preventive suggestions in perfecting current criminal law and judicial system, such as enhancing the development of mechanism and institution; carrying out the policy which tempers justice with mercy:taking light punishment for minors convicted of minor offences and severe punishments for cruel crime and serious social harm; making an appropriate reduction of the youngest age of criminal responsibility; taking much more severe punishment for those who commit brutal crimes with much more serious social negative effect.
