Research On The Causes And Measures Of Prevention For Chinese Minor Crime

Minor crime is a common problem in the world recently. In recent years, the number and the proportion of minor crime are always high in china, their criminal behavior has damaged the economy seriously and threat to social stability to a certain extent. Minor crime has become a hot issues and the prevention of minor crime is an urgent problem need to solve. There are common features in minor crime cases: first, the motive for the crime is simple, and most of crime is occasional and uncontrolled; second, the gang-based crime is the common forms; third, the types of crime is multiple and centralized; forth, the minor who commit crime is younger and younger; fifth, the criminal rate once more is high; sixth, the minor is both the victim and perpetrator. Both Chinese and Western scholars have their answers to the causes for the minor crime. The classical school thought that a criminal offense is caused by human selfishness, freedom of choice and utilitarianism; the biological school thought that a crime is a result of the biological characteristics, biological instincts , psychological and spiritual factors; the criminal sociologism thought that a crime is caused by social factors such as social structure, social conflict and so on. Chinese scholars believed that a crime is caused by the role of the individual and society, and there were specific and different standards. In this paper, I agree with the point of view of internal and external factors, I think the causes of minor crime is divided into internal factors and external factors. Among them, the internal factors are special physical and psychological factors, the external factors are the family factors, the school factors, the social factors and the judicial factors. Minor crime is a result of many factors. We know the specific causes of the minor crime to prevent and reduce minor crime. The prevention of minor crime is feasible and has great significance. At present, the prevention for minor crime in China has some success, but it can not form a joint force on the whole. In this paper, in connection with the theoretical criminal causes and the specific causes, I argue that the prevention of minor crime should adhere to some principle such as the combination of education and prevention, prevention timely, to deal with law and science. and I suggest we should take the specific measures: firth, the minors should improve their own quality and the ability of self-control, shape and perfect their character to play their main role in the prevention of crime; second, to focus on family education to strengthen the family crime prevention functions; third, to purify the social environment to reduce the temptation factors of minor crime; forth, to improve and reform the judicial system and educate the minor offenders. And it can be a relatively low level in minor crime as long as we attach importance to the issue of minor crime and continue to study the disciplines and the cause for it, and adopt effective measures to stop the source of minor crime.
