Education equality has been the focus of attention, countries are also committedto resolve and serve it as a basic educational policy starting point Since the foundingof the PRC, China has done a lot of work to solve the problem of inequality ineducation and to promote educational equality, then achieved remarkable results Butalong with the social transformation and social reform today, the field of educationemerges a series of new problems based on the original problem, and faces withsevere challenges in the protection and the realization of the equal education rightFrom a legal point of view, China’s higher education legislation system has seriousdefect, educational inequality common exist The united states is the earliest country inHigher Education Popularization,and it’s education law system is the most perfectstates too.From the history of the development of the United States, the highereducation equality legislation plays an important and powerful role in nationaldevelopment and social stability, therefore, it is necessary from the educationallegislation content point of view to study the United States how to pass legislation toalleviate the problem of equality in higher education faces in each period,the abovenot only has a far-reaching influence on the American educational development, alsohas a great inspiration for research on Chinese educational equality issues,theperfection of education law, and the security of educational equality rights of theminority and the vulnerable groups, also the diversification of the educational fundingThe paper consists of five parts The first part is the introduction, brieflyintroduces the reasons and significance of the research, through the analysis ofexisting research status, proposes the innovation and deficiencies The second part tothe four part reviews the history of the development of vulnerable group’s highereducation equality before world war II, fucus on the development process of theminority, women, poverty,and the disability from world war II to now,and analyzesthe development of each stage and the equal questions in higher education of theUnited States, The United States how to use the educational legislation address theseinequalities and the problems still in problem-solving process.The fifth part theresults and the insufficiency of American educational equality developing process,bases on the analysis of the equality of higher education in China, logically abstractedthe enlightenment of the experience of the United States Legislation to our country.
