It has been almost thirty years since the Decision on reform of the education system of thecentral committee of the communist party of China was issued in1985. During the thirtyyears, we have made great achievement in higher education reform. Internal managementsystem reform of colleges and universities has also made breakthrough. The nationalmedium-and long-term development planning outline (from2010to2020) regulates that wemust promote the government schools separated and separating management, implement andexpand the school-running autonomy, establish the modern school system with legality,self-management, democratic supervision, and social participation, and build a newrelationship between university, government and society. For common colleges anduniversities, it means to build a system in which government manages macro and universitiesgeared to the needs of the society. University charters are the legal basis to promote andspecify the independence of the universities. It is also the principle to deal with therelationship between universities, governments, and societies. The construction of universitycharters is the key condition for the success of universities’ internal management system inour country.Before1995, there are few colleges in our country that make university charters. And theimplementation is not optimistic. More and more colleges make university charters since2008. However, they are still in the minority from an overall perspective. From a structuralpoint of view, it is neither mature nor distinctive and needs to be improved. As puttingautonomous rights of running into practice and the appeal “de-administration”, universitycharters have become a very important issue in university education and educationalmanagement. The lack and imperfection of university charters makes it a empty slogan thatuniversities run schools according to law and autonomously manage according to charters. Asthe advance of market economic system, managing the universities by law and popularizationof higher education, problems in university charters become more and more prominent andrestrict the sustainable development of universities. As the saying goes, nothing can beaccomplished without norms or standards. University charter is the legal basis of runningschools by law. High school stature interim procedure that carried out since January1,2012,gives detailed explanations in contents, formulation procedure, check and supervision. The release of legal documents highlights the status and value university charters. As“constitution” in universities, university charter is the legal basis of practicing autonomousrights of running and constructing modern university system. Though there is more and morefocus from all sectors of society on construction of university charters, theoretical researchand building is still lagging behind. It is against the reformation and innovation ofmanagement system inside high school if we only discuss it from defect that exists inuniversity charters itself. So we need to discuss it in theoretical basis, to grasp the nature andcontent in general.This essay takes university charters construction as research object, and argues andanalyzes in history, international comparison and legal principle. It discusses the developmenttendency, value orientation and problems that may occur in making and implementinguniversity charters. It attempts to find the perfect path to provide reference and guidance foruniversity charters construction. It will promote the perfection of governance structure in highschool.
