The level of urbanization in China is lower than the average level of the world and that of the developing countries. Urbanization level is one of the important signs of a modern country and is the inevitable result of human civilization. At present, the lower urbanization level has severely affected the modernization in China.The factor that restricts the improvement of urbanization in our country is the high tension between population and land. Thus, to solve the land problem in urban development, particularly the issue of rural land use, is an important aspect in promoting the development of urbanization, and the rural land system is to play the decisive role in this matter. This thesis will start from this perspective and base on production force situation in rural areas and national realities so as to conduct research on rural land system in urbanization in China.To begin with, the author will analyze the relation between rural land system and urbanization and pointed out that rural land system is an important factor affecting urbanization in our country. The substantial leaps in China’s urbanization are closely related to rural land system. However, given the complexity of China’s urbanization, any change in land system cannot solve the entire problem for all good. Therefore, the rural land system should advance with the times. The existing rural land system had great effects on our urbanization, but along with the improvement of urbanization level, the inherent deficiencies and deep contradictions began to show up and became the biggest impedance in China’s urbanization. Then we can find out the necessity and significance of reforming the existing rural land system.Moreover, there are mainly three problems existing in the tenure of land in China. Firstly, the problems in land ownership:the ownership of land is not clear, the ownership of collective land is only nominal, and the farmers’legal rights cannot be guaranteed; Secondly, the problems in the transfer of managerial authority of rural land: the transfer process is not normative, the intervention from administrative authority is serious, the legal norms about transfer is deficient and the farmers’rights is impaired in transfer; Thirdly, the problems of confiscation of cultivated land:the system of confiscation is far from perfect, the cultivated land is confiscated and used wrongly, the standard of compensation is very low, the confiscation of cultivated land and the use of confiscation fund is not transparent enough and the farmers losing land is lack of social security. Furthermore, the author will examine the existing plans of rural land system and reach the conclusion that it is through basing on the production situation in rural areas and China’s reality that we can solve the problems with our rural land system.At last, the author will point out the overall direction of reform in rural land system and its principles. Then, the author design the reform plan of rural land system that is to carry out the plan step by step according to the reality in varied places. Meanwhile, the author also expounds the major supporting measures on rural land system reform.
