The land of China are divided into two kinds of state-owned land and collectiveland.the state-owned land use right reform has made great achievements after thirtyyears of reform and opening up,however, rural collective land use rights especiallythe transfer of construction land reform has floundered. Under the market economysystem, collective land shoule have the same role of allocating land resources,activating the economy, achieving the asset value of the land as state-owned land.the existing institutional arrangements,Collective land doesnn’t like the state-ownedland which have been achieved the equality in legal and the value of benefits ineconomic. the theoretical circles research has clearly failed in practice,long-standingurban-rural dual structure, differences in land using between urban to rural,all theseled to the circulation of collective construction land despite being banned. Whetherrural collective construction land transfer system is perfect or not, it is directly relatedto farmers, agriculture, stability and prosperity of rural,and of the national economyand sustainable development of society. Therefore, the study on how to regulate thecollective construction land, is extremely important.This paper analyzes rural construction land use right transfer status, and causescirculation difficulties. introducte China’s land policy and the evolution of thesystem briefly, time as clues to analyze the collective construction land of nationalpolicy from the ban to permission strictly under the control of the process flow in thelast ten years. Although the collective construction land has been in development, butthe flow of non-standard, damage to the interests of farmers in the circulation of thecollective construction land,and land issues such as low efficiency of resourceallocation are still the problems.The contributing factors of rural collective construction land are socio-economicfactors and institutional factors of land. Not only Farmland protection policy, landownership and land markets are institutional variables that affecting rural constructionland but the key point for Solution. The article from the above three points ofdeparture,by building rural construction land use rights transfer system(sound legalsystem, deep the right system), improve the rural land for construction of themechanisms(Rural land market, the interest allocation mechanism, the executivepower constraint mechanism), do a good job of supporting institutional support(Use control system, agricultural land protection, rural social security system) to proposestandards of the rural collective construction land measures.
