With the rapid development of China current economic, the scale of construction land will be increasing, the contradiction between the rising of construction land and the protection of cultivated land will aggravate, the situation of protecting cultivated land will be very serious. The conflicts of land expropriation constantly outbreak, affect the stability of the countryside, are dangerous for the social harmony. Meanwhile, because land expropriation system and financial system in China are not perfect, the local government power expansion desire scales-up, the phenomenon of illegal expropriation is endless. The rural political authority and political legitimacy are under attack. Therefore, land expropriation system is researched from the perspective of politics.This paper is divided into five parts, discusses the problems caused by land expropriation system from the perspective of politics, analyzes the reasons, and then constructs the perfect land expropriation system.The first chapter is introduction, mainly involving the thesis research background, research contents, the research methods, the technical route, etc.The second chapter is the current situation of land expropriation system and the crisis of political legitimacy caused by it, summarizes the current land expropriation system and its defects, analyses the crisis of political legitimacy, mainly including the political authority is weakened, the crisis of process identity, policy identity crisis and so on, clearing the seriousness of the problem of land expropriation system.The third chapter is the analysis of game imbalance. Land expropriation system causes the imbalance of expropriation game structure, the author analyses its basis, reason and source. Firstly, clearing the interests of every related interest subject in land expropriation game, reveals the original game driving of imbalance. Secondly, clear the sources of the imbalance of the game by analyzing the land expropriation power restriction of local government. Fair as the legitimacy foundation of the system of land expropriation system, requires that the system must give the landless peasants more participation opportunity, allowing them to enhance their ability of behavior. At the same time, democracy is the foundation that land expropriation system strengthens the political legitimacy, is practical need, and participation is the necessary approach to democracy. Based on fair and participatory democracy, public participation can enhance the action ability of farmers, protect their lawful rights and interests, set social foundation for land expropriation system.The fifth chapter is the reform mechanism of land expropriation system, puts the concept of public participation into the current land expropriation system in full. Firstly define the public-participation land expropriation system, emphasizes the importance and inevitability of participation, at same time, the public participation in land expropriation are summarized at home and abroad, according to the abroad enlightenment, participation must be putted into land expropriation system in China further, and make it be specialization, standardization and stabilization. Then elaborating the construction of public-participation land expropriation system, make public participation more specific and standard, the strengthening of farmers’participation ability makes public participation more feasible.
