China is one of the nations which are rich in marine fisheries resources. Theexplorations and utilizations of fisheries resources contribute great to China’sdevelopment of marine economy and national economy. However, the developmentpotential of marine fisheries is limited, and great increase of the gross can’t gloss over thefacts that the quality of marine fisheries has been decreasing and parts of populations aredanger in depopulation. Therefore, the innovation of property right system of marinefisheries resources asset has become one of the most important issues of China’s marinefisheries development which needs to be resolved urgently.In this paper, it mainly uses a combination of empirical and normative, static analysisand dynamic analysis, comparative analysis and other research methods, which achievethe integration of both theoretical and practical aspects. The purpose of this study lies inanalysis on the strengths and weaknesses of both the traditional administration of thefisheries regulatory system and the other system based on property rights, in order to findthe direction of regulatory reform for the sustainable development of fisheries. And thenthis paper proposes a reform path for the fisheries system through investigating ofproperty rights theory.Firstly, in the relevant theories, this paper has summed up the characteristics of thefisheries resources, sustainable development theory, property rights theory and fisheriesproperty rights theory. Then, it describes the traditional executive-led fisheries regulatorysystem and property rights based fisheries regulatory system which consists of individualtransferable quota system, the community quota system and common management system.Every system has different characteristics: traditional executive-led fisheries regulatorysystem to simplify the implementation process, while in property rights based fisheriesregulatory system, individual transferable quota system can improve the efficiency offishing, and co-management approach can save administrative costs. But the success ofeach method is unique. In practice, one should adopt the viable management practice. Inthe third part, this paper analysis all the property rights systems of marine fish resources in the world, which conclude a total allowable catch system, the individual quota system, theindividual transferable quota system, the community quota system, co-managementsystem etc.. Meanwhile, this part researches the various systems in successful fisheriesexperience abroad from the practical aspect. In the fourth part, this paper mainly analysisthe current fishery resources system in China. This part includes the basic situation of thefisheries resources, the historical changes of the fishery system, evaluation of the currentfishery system using DEA method which points out the problems in fishery resourcessystem. And then this part proposes the implementation of the path of fishery systemsbased on property theory.Finally, the conclusion of this paper is that the development trend of property systemof marine fishery resources in China. But based on the specific situation in China, forexample more people live on catching fish, the method of fishing is diverse, andindividual fishermen cannot protect the mobility of fishery resource, when choosing thefishing system between individual transferable fishing quotas and community fishingquota system, this paper suggest a community-based fisheries management andcommunity fishing quota system.
