Existence of spillovers brings about knowledge-sharing in large-scale clusters, which allows enterprises’innovations are easily imitated by other enterprises. To some extent, this damages the interests of enterprises with spillovering, impacts its activition of innovation. Therefore, we need to use intellectual property protection to protect innovations. However, the extra protection does not help other erterprises bur hinder technological progress in the development of the entire cluster. It must be set to an appropriate protection of intellectual property rights in order to promote the coordination of the enterprises in cluster and the sustainable development of the cluster.This paper conducts in-depth study of the theory of intellectual property protection based on the cluster. On the base of many previous scholars’study of individual enterprises, this paper emphasis on the two areas of research:industrial clusters and the moderation of protection of intellectual property rights. Also, based on the conclusion of a large number of domestic and foreign intellectual property rights and industrial clusters, it raises the objectives of this thesis study, the main study, as well as research methods and way. The papers studied in detail and depth from the body of the six areas.This paper conducts in-depth analysis of the current domestic and international intellectual property rights’protection and industrial clusters and finds that most prievious scholars used the method of empirical to study the protection of intellectual property rights, and the study associated with model is seldom. Therefore, it builds a two-stage game model called protection intellectual property rights—price, to try to resolve the problem that what extent to protect intellectual property rights is appropriate, and analysis the theory based on the model to identify the several factors impacting the protection of intellectual property rights including the extent of knowledge spillovers, the market effect of knowledge-sharing, the cost effect of knowledge-sharing and the competitive extent of cluster. These provide an appropriate basis for the in-depth study of the protection of intellectual property rights in industrial clusters. This paper focuses on an analysis of the impact of various factors for intellectual property protection, and divideds the development and evolution of the cluster into several different stages by the size of the factors, and carrise on the srtategy of appropriate intellectual property protection for the different characteristics of each stage.In this paper, the cluster theory of appropriate protection of intellectual property rights not only develops the theory of intellectual property protection and the industry clusters, but also presents a set of the theory of development of industrial clusters based on intellectual property protection, which has far-reaching theoretical and practical significance for the cluster core competitiveness, industrial clusters and regional economic’development.
