Study On The Influence Of Intellectual Property Protection On The Upgrading Of China's Export Commodity Structure

The Nineteenth National Party Congress clearly stated that China's economy has shifted from a high-speed growth stage to a high-quality development stage.The core of building a modern economic system is to promote high-quality development.The upgrading of export commodity structure is an important process of high-quality development.Intellectual property protection can improve the technical level of goods,reduce property rights disputes,and standardize the trading market,which is an important factor affecting the structure of export commodities.Xi Jinping proposed at the Boao Forum in 2018 that it is necessary to increase opening up to the outside world,to achieve a high level of trade and investment facilitation policy and strengthen the protection of intellectual property rights,we would reorganize the State Intellectual Property Office and improve law enforcement.Besides,we would increase the cost of illegality.In this context,this article will explain that how intellectual property protection has promoted the upgrading of China's export commodity structure.The paper first elaborated the mechanism of intellectual property rights protection to promote the upgrading of China's export commodity structure,and comprehensively analyzed China's current level of protection of intellectual property and the status of export commodity structure and trends by using export trade data of China in 1994-2015 and Sino-U.S in 2017.bilateral trade data.Then choose the level of intellectual property protection as the core explanatory variable to perform multiple linear regression analysis and intermediary tests,and combine the theoretical analysis based on the estimation results.The study finds that:Intellectual property protection affects the three major mechanisms of China's export commodity structure upgrade:First,it reduces domestic transaction costs through the invention patent system and encourages technological innovation;second,it protects the market power of Chinese companies and improves their international competitiveness through the trademark registration system.Third,through the patent law enforcement system to combat domestic and foreign intellectual property rights infringement,and promote independent innovation.However,the main problems are:China's intellectual property law enforcement is weak in transaction efficiency,China is facing foreign trade barriers and technological blockades in technological innovation,and China's export commodities are not competitive enough in market forces.Empirical research shows that China's high-and medium-technology goods are more responsive to intellectual property protection than low-tech goods.About 12.55%,6.84%,and 58.98%of the effects of intellectual property rights protection in the promotion of export product structure upgrades were achieved through the invention patent,trademark registration,and patent enforcement system.It shows that the intellectual property system can protect invention patents,increase trademark registration,strengthen patent enforcement,and promote the structural upgrading of export commodities.However,strengthening law enforcement is the most effective strategy for optimizing the structure of export commodities.Finally,the paper proposes that we must strengthen the rule of law in the construction of export commodities in order to improve transaction efficiency,refine and improve the intellectual property protection system,and increase punishment.Second,we must stimulate and protect corporate intellectual property rights to promote independent innovation of export enterprises and promote the transformation of intellectual property rights into export competitiveness.Third,we must support enterprises in protecting the power of the export commodity market with intellectual property rights,and pay attention to the international technological exchanges in the export commodity market.
